By accessing or using any services provided by ByteStable Hosting (“ByteStable”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all the terms and conditions of this agreement, you may not access or use our services.
2. Service Description
ByteStable provides web hosting, domain registration, and related services (“Services”). We reserve the right to modify or discontinue any Service at any time without notice.
2.1 Service Levels
Our Services are offered at different levels with varying features and resource allocations:
- Shared Hosting: Resources are shared among multiple customers
- VPS Hosting: Dedicated virtualized resources
- Dedicated Servers: Entire physical server resources
- Managed Services: Fully managed hosting solutions
2.2 Uptime Guarantee
ByteStable provides web hosting, domain registration, and related services (“Services”). We reserve the right to modify or discontinue any Service at any time without notice.
3. Account Registration
To access certain Services, you must register for an account and provide accurate, complete information.
3.1 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your contact information remains current
3.2 Age Requirement
You must be at least 18 years old to register for an account and use our Services.
4. Payment and Billing
Our Services are offered on a subscription basis with various billing cycles available.
4.1 Pricing
All prices are in INDIAN RUPEES (INR) unless otherwise specified. We reserve the right to change prices at any time, with notice provided to existing customers.
4.2 Refund Policy
We offer a 7-day money-back guarantee for shared hosting plans. VPS and dedicated servers are eligible for prorated refunds within 7 days of service activation. Domain registrations and SSL certificates are non-refundable.
5. Acceptable Use Policy
You agree not to use our Services for any unlawful purpose or in any way that might harm, disrupt, or impair our services or networks.
5.1 Prohibited Content
The following content is strictly prohibited:
- Illegal material or content that facilitates illegal activity
- Malware, viruses, or other harmful software
- Pirated software or media
- Phishing or fraudulent sites
- Spam-related content
- Adult content (except on designated servers)
- Content that infringes on intellectual property rights
5.2 Resource Usage
The following content is strictly prohibited:
- Illegal material or content that facilitates illegal activity
- Malware, viruses, or other harmful software
- Pirated software or media
- Phishing or fraudulent sites
- Spam-related content
- Adult content (except on designated servers)
- Content that infringes on intellectual property rights
6. Data Protection and Privacy
Our Privacy Policy explains how we collect, use, and protect your personal data. By using our Services, you agree to our collection and use of data as described in the Privacy Policy.
6.1 Backups
While we perform regular backups, you are responsible for maintaining your own backups of all data. We are not liable for any data loss.
7. Suspension and Termination
We may suspend or terminate your account at any time with or without notice for conduct that violates these Terms or our Acceptable Use Policy.
7.1 Consequences of Termination
Upon termination:
- All rights granted under these Terms will immediately cease
- You must immediately cease all use of the Services
- We may delete all data associated with your account
7.2 Data Retrieval After Termination
After termination, you may request a copy of your data within 14 days. After this period, we may permanently delete all data.
8. Intellectual Property
All content included in our Services, including text, graphics, logos, and software, is our property or the property of our licensors and is protected by copyright laws.
8.1 Your Content
You retain ownership of any intellectual property rights in the content you upload to our Services. By uploading content, you grant us a worldwide license to use, host, and reproduce the content solely for providing the Services.
9. Limitation of Liability
To the maximum extent permitted by law, ByteStable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
9.1 Maximum Liability
Our total liability for any claims related to the Services shall not exceed the amount you paid for the Services during the six-month period preceding the claim.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes through our website or via email. Your continued use of the Services constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
11.1 Dispute Resolution
Any disputes shall be resolved through binding arbitration in Delaware in accordance with the rules of the American Arbitration Association.
